If you have suffered a brain injury or spinal injury as a result of a motor vehicle accident, work accident or other incidents such as a fall or assault, you may be entitled to make a claim for compensation.
The claim will be made against the party at fault (or at least partially at fault). Often that party will have insurance and sometimes that party will not. It is important to ascertain whether insurance exists at an early date and we can attend to that promptly.
The Claim
Acquired brain injuries, as well as back and neck injuries, will almost always have a significant impact on the victim's ability to carry out day to day activities. Depending on the way in which you were injured, you may be entitled to claim compensation for the significant number of hours that friends or family members will be providing you with domestic assistance. In addition, damages can be claimed for:
- Pain and suffering
- Loss of wages/income (past and future)
- Medical expenses (past and future)
- Out of pocket expenses (e.g. the cost to modify your home for wheelchair access)
Early intervention through the use of occupational therapists, speech therapists, physiotherapists and neurologists is absolutely critical. The law places an onus on the party at fault to assist with rehabilitation expenses at an early date and often we can arrange for those expenses to be covered in the early stages of the claim.
Wheel Chairs
If the injuries sustained result in your being confined to a wheel chair, there are special considerations, for example, a claim will need to be made for things such as:
- Modifications to the home; and
- Purchase of an appropriate vehicle to accommodate the wheel chair.
